ORDER
(Order of the Court was made by S.MANIKUMAR, J) A practicing Advocate has sought for a writ of mandamus, directing the State of Tamil Nadu, rep. through the Chief Secretary, Chennai and the Inspector General of Registration, Chennai, the respondents 1 and 2 respectively, to incorporate an
option via. Advocate option along with citizen and document writer in the user type to create an account in the Inspector General of Registration's Portal.
2. Petitioner has contended that there is a separate option for Document Writer and General Citizens. Contending inter alia that an Advocate is inseparable from the Registration Department in the matter of assisting person, for preparation of document and registration thereof, in the office of Sub Registrars or District Registrar, as the case may be, petitioner has sought for a mandamus, as stated supra.
3. Mr.T.M.Papaiah, learned Special Government Pleader submitted that request for creation of login as Advocate in Registration Department's website, has already been considered and ordered. He has also submitted that vide letter dated 07.02.2019, Secretary, Bar Council of Tamilnadu and Puducherry, has been addressed to provide the list of Advocates for confirmation to enable the login to function. Details are as hereunder.
"In the Registration Department's web site (https://tnreginet.gov.in), three types of stake holders can create logins by Registering themselves as "Advocate / Citizen / Document Writer", by providing the necessary details.
The provision of creating logins as "Advocate" has been provided from 29.1.2019 in the Registration Department's web site. From the date of enabling the provision to till 6.2.2019, there are 211 Advocates registered in the web site as "Advocate" for the purpose of creating document and for accessing the allied services of Registration Department.
The process of creating login for Advocates:
The simple process of Registration in the web site as Advocate is explained below:
➔Click on "Registration"
➔"User Registration"
➔Click on "User Type"
➔Select "Advocate"
➔Provide the following details:
1. User Name
2. Password
3. Security question & Answer
4. Name
5. E-mail
6. Date of Birth
7. Gender
8. Mobile Number
9. Identification Number 10.Address 11.Bar Council Number
After providing all the above details and on agreeing the following conditions published in the web site, the user Registration details of the Advocate will be submitted to the Registration Department officials for verification. In particular to verify the "Bar Council Number" provided during the Login creation process. "Note:
1. You must avail any one of Registered User's Services within 7 days from the date of creation of user profile (New Users). Otherwise, your user id will be deactivated automatically.
2. You must avail any one of Registered User's Services every 3 months from the date of last activity (Existing Users). Otherwise, your user id will be deactivated automatically.
3. Your account will be activated within 15 days." On verification of the above submitted details by the IGR office officials, Advocate Login will be enabled. Once the Logins are enabled, they can create the documents and access the allied services available in the portal.
In this regard a letter No.55969/CS1/13 dated 7.2.2019 has been addressed to "The Secretary, Bar Council of Tamil Nadu and Puducherry" by providing the list of Advocates for confirmation to enable the login. Once the confirmation received from them, Advocates login will be enabled for the confirmation received users."
