..Respondent(s) This petition is filed under Article 226 of Constitution of India, to modify the order to the extent that arrears of salary and all retiral and incidental benefits with interest @12 percentage per annum with effect from the due date as directed by the Finance (Pension) Dept., dated 15.06.1987 and G.O.Ms.No. 122 Finance(Pension) Dept., dated 20.02.1995 and not from the retirement date and as well prays sanction of statutory time scale of pay with effect from 31.01.2007 in the post of Night Watchman held by the petitioner and also accord sanction of pension with effect from 01.01.2025 with all benefits similarly placed retired employees granted earlier in terms of said government order or orders if any passed in a similar case by this Honble Court. ORDER
This petition has been filed to modify the order to the extent that arrears of salary and all retiral and incidental benefits with interest @12 percentage per annum with effect from the due date as directed by the Finance (Pension) Dept., dated 15.06.1987 and G.O.Ms.No. 122 Finance(Pension) Dept., dated 20.02.1995 and not from the retirement date and as well prays sanction of statutory time scale of pay with effect from 31.01.2007 in the post of Night
Watchman held by the petitioner and also accord sanction of pension with effect from 01.01.2025 with all benefits similarly placed retired employees granted earlier in terms of said government order or orders if any passed in a similar case by this Hon'ble Court.
2.Since this Court previously and conclusively ordered payment of interest at the rate of 6% per annum , there cannot be any modification. Accordingly, this petition is dismissed.
