JUDGMENT

This civil miscellaneous appeal has been directed against the order dated 17.7.2009 made in W.C.No.10 of 2007 by the Deputy Commissioner of Labour-II, Chennai awarding a compensation of Rs.4,36,320/- to the claimants. It is now stated by the learned counsel for the appellant/Insurance Company that the entire amount of compensation was already deposited to the credit of the W.C.No.10 of 2007 on 1.10.2009 and since the claimants had also withdrawn the compensation amount, nothing survives in the appeal.

2. Considering the fact that it is a case of fatal accident and that the claimants have also withdrawn the entire compensation amount deposited by the appellant/Insurance Company, this civil miscellaneous https://hcservices.ecourts.gov.in/hcservices/

appeal stands dismissed, as nothing survives for adjudication. Consequently, M.P.No.1 of 2010 is also dismissed. No costs.
