MAHADEVAN CMP No.2070 of 2019 IN AS.35/2019 K.THANGAVEL [ PETITIONER ] Vs S.EASWARAMOORTHY [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to stay the Judgment and Decree dated 28/02/2018 passed in OS.NO.19/2017 on the file of the Second Additional District Judge , Erode (CMP.2070/2019) pending disposal of the above Appeal AS.35/2019 Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.N.NITHIANANDAM, Advocate for the petitioner and Respondent not appearing either in person or by an Advocate the court made the following order:- In this petition, by order dated 30.01.2019, this Court granted interim order of stay on condition that the petitioner pays 50% of the decree amount within a period of eight weeks from the date of receipt of a copy of the order.

2.The learned counsel for the petitioner is unable to answer as to whether the amount ordered to be deposited has been deposited or not.

3.In the circumstances, this petition is closed by virtue of the specific clause in the order dated 30.01.2019, as stated in paragraph-1 above.

4.Post the appeal after four weeks.
