ORDER

This application has been filed to permit the applicant to file Additional Documents Photo copy of RTI details dated 21.11.2024 in C.S.No.101 of 2022.

The learned counsel for the applicant would submit that the applicant seeks to mark photo copy of the information received by him under the Right to Information Act with regard to two F.I.Rs to substantiate the conduct of the defendant. He would submit that no prejudice would be caused to the respondent/defendant as it is only a matter of public record. Therefore, he

would seek the permission of this Court to file the additional documents.

3. On the other hand, the learned counsel appearing for the respondent would submit that what is sought to be marked is only a photo copy of the information received by the applicant under the Right to Information Act. He would further submit that no useful purpose would be served in allowing to mark the documents. The present application was filed only to protract the proceedings by allowing the suit to be pending against the respondent.

4. I have considered the submissions made by the learned counsel on either sides.

5. It is the case of the applicant that the applicant had been arrested based upon the false and frivolous complaint given by the respondent/defendant. He had sought information under the Right to Information Act regarding the facts, for which, he was given with the information that he had been detained based upon the complaints under FIR No.81/2022 on the file of H-3, Tondiarpet Police Station and FIR No.112/2022 on the file of N-1, Royapuram Police Station and that he had been released on the basis of bail on the respective dates.

6. This document is only sought to be filed in support of his claim. Since the document that is sought to be marked would also support the claim of the plaintiff, this Court is inclined to allow the application as prayed for, but however, subject to proof.

7. In fine, the application in A.No.987 of 2025 in C.S.No.101 of 2022 is ordered with the above observations.
