J U D G M E N T

The learned counsel appearing for the first respondent filed a typed set of papers enclosing a compromise said to have been entered into between the parties on 23.09.2003 out of the Court, whereby one of the parties in the appeal agreed to execute the sale deed in favour of one of the appellant firm. 2.The learned counsel for the respondent also stated that pursuant to the compromise referred to above, a sale deed has been executed in favour of one of the partners of the appellant partnership firm. The said submission made by the learned counsel is hereby recorded.

3.In view of the above, nothing survives in the Second Appeal. Hence, the second appeal is dismissed as having become https://hcservices.ecourts.gov.in/hcservices/

infructuous. No costs. Consequently, the connected miscellaneous petition is closed.
