PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the first respondent to transfer the investigation in Crime No.203 of 2023 pending on the file of the 3rd respondent police to any other police station in Cuddalore district and to file a charge sheet u/s.173(2) of Cr.P.C before the Jurisdictional Court.

ORDER

This criminal original petition has been filed to direct the first respondent to transfer the investigation in Crime No.203 of 2023 pending on the file of the 3rd respondent police to any other police station in Cuddalore district. 2.The learned Additional Public Prosecutor appearing on behalf of the respondents submitted that investigation was completed and draft charge sheet is also ready and that some time is required to file the final report before the concerned jurisdictional Court.

3.In the light of the above submission and also taking into consideration the fact that the petitioner has also been arrayed as an accused (A2) in this case, this Court cannot grant the relief as sought for in this petition. Ultimately, after the final report is filed and the same is taken on file by the concerned jurisdictional Court and summons are issued to the petitioner, it is left open to the petitioner to workout his remedy in the manner known to law.
