ORDER

The petitioner-wife has filed the present transfer petition seeking to withdraw the HMOP.No1678 of 2024 filed by the respondent-husband before the Family Court, Coimbatore and transfer the same to Family Court, Tiruppur.

2. The respondent has filed a petition for divorce in H.M.O.P. No.1678 of 2024 on the file of Family Court, Coimbatore. The petitionerwife has filed the present transfer petition seeking to transfer the said HMOP to Family Court, Tiruppur, on the ground that the petitioner is residing with her one year old child at Tiruppur at her parent's house. She would submit that the respondent-husband exercise a great deal of clout at Coimbatore and he has deliberately filed the petition for divorce before the Family Court, Coimbatore, only to harass the petitioner. She also would submit that she and her minor child have not received any maintenance from her husband and that they are depending on her parents for their livelihood. In such circumstances, she could not bear the transportation charges involved in travelling to Coimbatore to attend the hearings. Hence, she seeks transfer.

Considering the fact that the petitioner is facing difficulties in attending the Court at Coimbatore both physically as well as monetarily, more particularly, since her presence before the Family Court for every hearing is mandatory, her request for transfer appears to be justified and accordingly, the Tr.CMP is allowed, and H.M.O.P.No.1678 of 2024 pending on the file of Family Court, Coimbatore is withdrawn and transferred to 2/4

Family Court, Tiruppur. No costs. Consequently, connected miscellaneous petition is closed.
