ORDER

This petition has been filed to relax the condition imposed upon the petitioner in Crl.O.P.No.19552 of 2024 dated 19.11.2024, passed by this Court to trail Court on all hearing days at 10.30a.m without fail.

2. Though this condition has been imposed to make the petitioner to appear and cooperate for the trial process, it is mandatory to the petition to appear before trial court every hearing.

3. If the petitioner is not in a position to appear on the particular date, he is always entitled to file appropriate petition for dispensed with the presence of the petitioner for that particular date. Hence, I am of the view that there is no need for relaxing the condition imposed on the petitioner and he is entitled to file appropriate petition, whenever, he is not in a position to appear on the particular date.

4. With this observation, this Criminal Miscellaneous Petition stands dismissed.
