PRAYER: Appeals under Section 96 of the Code of Civil Procedure, 1908, against the judgment and decree made in LAOP No.572 of 1987 on the file of the Learned Subordinate Judge, Poonamalle dated 31.08.2000.
DECREE: This Appeal coming on for hearing on this day upon perusing the grounds of Appeal, the order of the Lower Court and the material papers available in this case and upon hearing the arguments of Mr.J.Balagopal, Special Government Pleader (AS) appearing on behalf of the Appellants and Mr.J.Antony Jesus, Advocate for Respondent and this Court while Allowing the First Appeal in part and the modifying the Judgment and decree of the Trial Court doth order and decree as follows:
1) that the judgment and decree dated 31.08.2000 made in LAOP.Nos.572 of 1987 dated 31.08.2000 be and hereby is modified by reducing the compensation amount from Rs.4,875/- (Rupees Four Thousand Eigh Hundred and Seventy Five only) to Rs.2,500/- (Rupees Twenty Five Thousand only) per cent together with other statutory dues i.e., solatium, Additional compensation and interest, as per provisions governing the payment of compensation.
2) that the appellants herein/Referring officer be and hereby are directed to pay the compensation for the Respondent / Claimant within a period of twelve (12) weeks from the date of receipt of a copy this judgment with all other statutory benefits.
