2. When the matter is taken up for hearing today, the learned counsel for the appellant states that as per the award passed by the Tribunal, a sum of Rs.4,21,572/- was deposited to the credit of M.C.O.P.No.12 of 2003 before the Tribunal and the same was withdrawn by the claimants.

3. In view of the above submission, nothing further survives for adjudication in this Civil Miscellaneous Appeal. Hence, the Civil Miscellaneous Appeal is dismissed. There shall be no order as to costs.
