IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED : 21.07.2017
CORAM
THE HONOURABLE MR. JUSTICE S.M.SUBRAMANIAM WP.No.10071 of 2017 Helenanita ... Petitioner
Versus
The State Rep. By The Superintendent of Police, Kancheepuram District, Kancheepuram.
... Respondent Writ Petition filed under Article 226 of the Constitution of India praying for a writ of Certiorarified Mandamus calling for records pertaining to the proceedings of the respondent in Proc.No.Na.Ka.En:M1/3559/2016, dated 27.12.2016 and to quash the same and consequently direct the respondent to provide the compassionate appointment to the suitable post for the petitioner pursuant to her application dated 01.01.2016. For Petitioner :
M/s.R.Thirumoorthy For Respondent :
Mr.K.Dhananjayan, Special Government Pleader
ORDER
The relief sought for in this writ petition is for quashing of the order of rejection issued by the respondent on 27.12.2016 in relation to the claim of the petitioner for compassionate ground appointment.
2.
Though the larger relief sought for in this writ petition, the learned counsel appearing for the writ petitioner now restricted the prayer sought for by stating that the order issued by the Government in G.O.Ms.No.78, Labour and Employment Department dated 21.04.2017 has not been considered by the respondent, at the time of passing of the impugned order in this writ petition. Thus, it is suffice, if a direction is issued to reconsider the entire claim of the writ petitioner with regard to compassionate ground appointment and an order considering G.O.Ms.No.78 dated 21.04.2017 is passed.

3.
In view of the restricted prayer sought for by the learned counsel appearing for the petitioner, this Court is of the view that such a direction is just in view of the government order passed in this regard. Accordingly, the respondent is directed to consider the application submitted by the writ petitioner seeking compassionate ground appointment afresh in the light of the Government order in G.O.Ms.No.78, Labour and Employment Department dated 21.04.2017, within a period of twelve weeks from the date of receipt of copy of this order. 4.
With these observations, the writ petition stands disposed of. No Costs.
