Prayer:- Writ Petition filed under Article 226 of the Constitution of India, praying for a issuance of Writ of Mandamus, to direct the first respondent to take appropriate action on the petition filed by the petitioner under Section 84 of the Puducherry Co-Operative Societies Act 1972 dated 26.07.2018.

ORDER

This writ petition has been filed seeking direction to the first respondent to dispose of the petitioner's application filed under Section 84 of the Puducherry Co-operative Societies Act.

2. Heard the learned counsel appearing for the petitioner and the learned Public Prosecutor (Pondy) appearing for the respondents.

3. According to the petitioner, challenging the election conducted to the second respondent co-operative society on 27.05.2018, the petitioner is said to have filed an application under Section 84 of the Act, but the same was not considered https://hcservices.ecourts.gov.in/hcservices/

by the first respondent so far.

4. The learned Government Pleader (Pondy) appearing for the first respondent, on instructions, submitted that the application filed by the petitioner is admitted for adjudication and now the matter is pending with the Co-Operative Officer (Credit), vide proceedings dated 01.08.2018 for adjudication in accordance with law.

5. Considering the fact that the application has been filed on 26.07.2018, the first respondent is directed to dispose the application on its own merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order, after issuing notice to the petitioner and other interested parties.
