ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested on 11.12.2021 and remanded to judicial custody on 13.12.2021 for the offences under Sections 341, 294(b), 323, 336, 427, 387, 307 and 506(ii) of IPC, in Crime No.795 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that, due to wordy quarrel between the petitioner and the defacto complainant, the petitioner assaulted the defacto complainant and threatened him with broken beer bottle and also snatched a sum of Rs.1,500/- from him at the knife point. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration for more than 25 days from 13.12.2021. Hence, the learned counsel would pray for grant of anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the petitioner is a history sheeter and he has got 9 previous cases out of which, one murder case was registered and would submit that if he is released on bail he may tamper the evidence.

5.Considering the grave nature of offence and the fact that the petitioner has got 9 previous cases and one murder case was registered, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
