Prayer: Writ Petition is filed under Article 226 to issue a Writ of Mandamus directing the 2nd and 3rd Respondent to survey the subject property bearing an extent of 6.75 acres comprised in S. No. 155, situated at Perumapalayam, Vazhapadi Taluk, Salem District. For Petitioner :

Seeking a mandamus to the respondents 2 and 3, to survey the property, the petitioners are before this Court.

2. It is the case of the petitioners that they have inherited the subject property from their grand mother, Chinnammal @ Krishnammal. The petitioners decided to sell the property. Therefore, the petitioners submitted an online application for conducting survey of 2/6

their property. However, the respondents failed to survey the subject property. Therefore, the petitioners are before this Court.

3. Heard the learned counsels on the either side and perused the records.

4. Considering the facts and circumstances of the case, a mandamus is issued to the respondents 2 and 3, to conduct survey of the petition mentioned property. The petitioners shall submit all the relevant records to show their title to the property and the respondents shall, after issuing notice to the adjacent land owners and interested parties, hold an enquiry and thereafter, proceed to pass orders either surveying and subdividing the property or rejecting the request. In the case of a rejection, a speaking order shall be passed. The aforesaid exercise shall be completed within a period of 12 weeks, from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is allowed. Consequently, the connected miscellaneous petition is closed. No costs.
