O R D E R

(The case has been heard through video conference) Petitioners, who were arrested and remanded to judicial custody on 15.12.2020 for the offence punishable under Sections 464, 465, 468, 471, & 420 of IPC in Crime No.862 of 2020, seeks bail.

2. It is a case of job racketing. Totally there are five accused and the petitioners are A1 and A2. The case of the prosecution is that all the accused persons, under the guise of getting employment in foreign countries, collected huge amount from 40 victims and thereafter, failed to do so and they have also issued bogus visa and flight tickets. The allegation against the petitioners is that they have received the entire amount from the victims and Hence, the case was registered.

3. The learned counsel for the petitioner would submit that the petitioners are no way connected with the offence as alleged by the prosecution and only, the other accused have received the entire mount from the victim and the petitioners have been falsely implicated in this case. Hence, he prays to grant bail to the petitioners.

The learned Additional Public Prosecutor, on instructions, vehemently opposed for granting bail stating that the petitioners are the main accused and they only received the amount from the victims and if the petitioners are released on bail, they may tamper the witnesses. She would further submit that totally more than Rupees One Crore is involved in this case.

5. Considering the facts and circumstances of the case, and taking note of the fact that huge amount is involved in this case, this Court is not inclined to grant bail to the petitioners and the Criminal Original Petition is dismissed accordingly. -sd/- 10/02/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
