O R D E R
This Writ Petition has been filed seeking for issuance of Writ of Mandamus directing the respondent to receive the Application Form CCPA dated 27.03.2018 with prescribed fees and to grant the Maxi Cab Permit in respect of the vehicle bearing Reg.No.TN-02-AP-8687 forthwith.
2.The learned counsel appearing for petitioner has stated that the petitioner has purchased TATA Ace Magic vehicle bearing Reg.No.TN-02-AP-8687, with a seating capacity of 7+1=8. The said vehicle is covered by Maxi Cab Permit, which is valid up to 07.11.2020. Since the said vehicle had major repairs, the petitioner was unable to pay the tax for the quarter ending 30.09.2017. Subsequently, the petitioner had approached the respondent for the payment of tax with due penalty. Due to nonpayment of tax for the quarter ending, the permit for the said vehicle was cancelled by the respondent. The learned counsel further submitted that since the petitioner has not received the order cancelling the permit, the petitioner has submitted a fresh Application Form CCPA with prescribed fees on 27.03.2018 https://hcservices.ecourts.gov.in/hcservices/
for permit. The respondent, instead of accepting the application, refused to receive the Application Form CCPA with the prescribed fees. Since the respondent refused to receive the Application, the petitioner seeks direction to the respondent to receive the Application Form CCPA dated 27.03.2018 with prescribed fees and for grant of Maxi Cab Permit in respect of the vehicle bearing Reg.No.TN-02-AP-8687.
3.The learned Special Government Pleader appearing for the respondent has submitted that the respondent will receive the Application Form CCPA with prescribed fees from the petitioner and consider the same within a period of two weeks. 4.Recording the submission made by the learned Special Government Pleader, the Writ Petition is disposed of with a direction to the respondent to receive the Application Form CCPA with prescribed fees and consider the same and pass appropriate orders within a period of two weeks from the date of receipt of a copy of this order. No costs.
