ORDER
The petitioner, who was arrested and remanded to judicial custody on 22.11.2025 for the offence under Sections 316(5) @ 316(5), 61(2), 318(4) of BNS, 2023 in Crime No.365 of 2025, registered on the file of the respondent police, seeks bail.
2. The allegation is that the petitioner herein while working as a clerical __________Page 1 of 4
staff under the de facto complainant firm, taking advantage of his proximity with the accounts of the firm, involved in siphoning of of 2.5 crores from the firm bank accounts to his friend's account who is ranked as A2 in this case and thereby misappropriated the money.

The learned Counsel for the petitioner submitted that the petitioner herein as clerical staff and he has no occasion to deal with the properties and the bank accounts of the firm and further submitted he has been falsely implicated in this case and he is incarcerated from 22.11.2025 and ready to cooperate with the investigation and hence, pleased to grant bail.

The learned Government Advocate (Crl.Side) reiterated the case of the prosecution and submitted that A2 in this case is still absconding and he is friend of A1 and accounts details have been furnished before this Court to show that under 5 heads of expenditure, he transacted Rs.2.4 crores and the same was sent to the bank account of A2. He further submitted that investigation is pending.

I have gone through the statement recorded from the petitioner and also the connected records and it reveals that the petitioner having proximity with the bank accounts of the defacto complainant had transferred Rs.2.4 crores of money from the bank accounts of the defacto complainant to the bank account __________Page 2 of 4
of the petitioner's friend who is ranked as A2 and so far money is not recovered and A2 is still absconding and if bail is granted, there is likelihood of hampering the investigation process. Hence, this Court is not inclined to grant bail.
