This application is filed to grant leave to sue the second defendant before this Court in this suit.
2. I heard the learned Senior Counsel for the applicant.
3. The learned Senior Counsel submitted that the cause of action for the suit arose within the jurisdiction of this Court where the first defendant is situated and where proceedings were initiated in respect of the proposed AGM, which is to be held on 12.01.2020. Therefore, he submitted that the cause of action arose within the jurisdiction of this Court and that leave is requested because of the second defendant is situated in New Delhi.
4. Upon considering the submission of the learned Senior Counsel for the applicant and on perusing the affidavit in support of this application, it is clear that the cause of action has arisen within the jurisdiction of this Court and therefore this application is liable to be allowed.
5. Accordingly this application is allowed and the applicant is granted leave to sue the second defendant before this Court. 09.01.2020 kv Note:
1. Registry is directed to list the application for injunction, if it is otherwise in order on 10.01.2020.
2. Issue order copy on 09.01.2020.
