ORDER : The Court Made the following order The petitioner, who was arrested and remanded to judicial custody on 08.12.2020 for the alleged offence punishable under Section 399 IPC, in Crime No.142 of 2009 pursuant to the NBW issued on 19.03.2019 in PRC No.5 of 2010 by the the Judicial Magistrate, Thiruvottiyur, Tiruvallur District, seeks bail.
2. There are totally three accused in this case and the petitioner is A3. Earlier, the petitioner was granted bail and subsequently, since he was absconding, NBW was issued on 19.03.2019 and he was arrested and remanded to judicial custody on 08.12.2020.
3. The learned counsel for the petitioner would submit that the petitioner is regularly appearing before the trial Court and the abscondance of the petitioner is false and only for the reason that the petitioner is having 27 previous cases, the respondent police arrested him. Hence, he prays for grant of bail.
4. The learned Additional Public Prosecutor would submit that the petitioner is having 27 previous cases which are all similar in https://hcservices.ecourts.gov.in/hcservices/
nature. If the petitioner is released on bail, there may be chances that he will again abscond and thereby, the entire trial proceedings will be affected. Hence, she vehemently opposed for grant of bail to the petitioner.
5. Considering the submission made by the learned Additional Public Prosecutor that the petitioner is already involved in 27 previous cases which are all similar in nature, this Court is not inclined to grant bail to the petitioner.
6. Accordingly, this Criminal Original Petition stands dismissed.
