For Applicant : Ms.D.Roobinichitra For Respondents : Mr.Palaniandava ----- COMMON ORDER Both these applications have been filed to amend the plaint by bringing on record the 2nd respondent as the 2nd defendant in the suit and as the 2nd respondent in the Interlocutory Application No.5206 of 2017.
2. The learned counsel for the respondent laid a preliminary objection stating that the proper application that should have been filed was to implead the said respondent as a party defendant and as a party respondent in the application.
3. The learned counsel for the applicant requests permission to withdraw the present applications with liberty to file further applications 2/3
under the correct provisions of law and with the correct reliefs sought in the applications. Such permission is granted. Both the applications are dismissed as withdrawn. Liberty is granted to file necessary application wording relief properly and giving the correct provision of law.
4. Both the applications are dismissed as withdrawn and liberty is granted as stated above. No order as to costs.
