Prayer: Writ petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus to call for the entire records pertaining to the notification of the 3rd respondent in REF.NIT.No.2/2017/2018/ (M&M) CIRCLE/CHENNAI dated 20.02.2018 and quash the same and consequently directing the respondents to conduct tender by previous system i.e., token system for quarrying of sand. Mr.E.Manoharan, learned Additional Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal.
2. The petitioner is aggrieved against the tender notification issued by the 3rd respondent dated 20.02.2018 by complaining that he was not able login the particular e-tender page, despite his repeated attempts made before the cut off date.
3. Though the petitioner made certain allegations as if he was prevented from taking part in the e-tender in order to facilitate some interested persons, this Court, at this stage, is not expressing any view on such allegation in view of the statement made by the learned Additional Government Pleader that the respondents have decided to issue a fresh tender insofar as the particular quarry, for which, the petitioner is having grievance and therefore, as and when any such fresh tender notification is issued, it is for the petitioner to participate. Learned Additional Government Pleader also submitted that the allegation made by the petitioner are totally baseless, more particularly, when the website is not run by the respondents and on the other hand, it is run by the National Information Centre, a Body of the Central Government, which is not a party before this Court.
4. Recording the above statement made by the learned Additional Government Pleader, this writ petition is closed as no further order is necessary in this writ petition. No costs.
