ORDER

The petitioner herein, who apprehend arrest at the hands of the respondent police in respect of the Non-Bailable Warrant issued by the learned II Additional District and Sessions Court, Chidambaram in S.C.No.42 of 2024 for the alleged offences under Sections 294(B), 427, 506(ii) of IPC r/w 3 of TN Public Property (Prevention of Damage & Loss) Act, 1992, in Cr.No.121 of 2018 seeks anticipatory bail. 1/4

When the matter is taken up for hearing today, the learned counsel appearing for the petitioner submitted that the petitioner herein is arrayed as A4 in this case and due to his non-appearance, the Trial Court issued non-bailable warrant to A4 on 12.09.2024; that the petitioner is ready to surrender, therefore, he seeks anticipatory bail to the petitioner. 3.

Learned Government Advocate (Crl. Side) appearing for the respondent police would submit that the petitioner herein was arrested and released on bail; for the offences under Sections 294(B), 427, 506(ii) of IPC r/w 3 of TN Public Property (Prevention of Damage & Loss) Act, 1992, that the respondent after completion of investigation, filed the charge sheet on 29.04.2024 in S.C.No.42 of 2024 before the learned II Additional District and Sessions Court at Chidambaram; that the petitioner herein have not appeared for the Trial, the Trial Court has issued non-bailable warrant against the petitioner herein and the same is pending. 4.

Considering the representation on both sides and that the NBW is pending against the petitioner, it is appropriate to direct the petitioner to appear before the Trial Court, where NBW is pending, by filing an appropriate petition to recall the non-bailable warrant. Accordingly, the 2/4

petitioner is directed to appear before the Trial Court by filing appropriate application to recall the NBW issued against them and if any such application is filed, the Trial Court is directed to consider the said application on the same day on merits in accordance with law. With the above directions, this criminal original petition is disposed of.
