Writ petition is filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus to issue a Writ of Certiorarified mandamus or any other appropriate writ or order or direction in the nature of a Writ calling for the records of the respondent culminating in his impugned bill for the month of December 2019, quash the same insofar as it relates to the levy of Rs.6,23,028/- (Rupees Six Lakhs Twenty Three Thousand and Twenty Eight only) towards MD penalty charges for the petitioners service connection LT SC 238.

It is brought to the notice of this Court that the petitioner had taken a fixed deposit for a sum of Rs.6,23,028/- in the name of the Registrar General, High Court and submitted the original fixed deposit receipt before the Registry on 28.01.2020. During the pendency of the Writ Petition, the maximum demand penalty that was invoked against the petitioner was cancelled through proceedings dated 12.02.2020. Hence, the petitioner has sought for the permission of this Court to withdraw the Writ Petition.

2. This Writ Petition is dismissed as withdrawn and the petitioner is permitted to make a representation to the Registrar General, High Court along with a copy of this order and on receipt of the same, the original Fixed Deposit Receipt shall be handed over to the petitioner and the petitioner shall be permitted to withdraw the amount in the fixed deposit.
