Respondent PRAYER: Criminal Revision petition has been filed under Sections 397 and 401 of the Code of Criminal Procedure, against the judgment and order of dismissal of petition under section 45 of Indian Evidence Act to send the Cheque bearing No.750651 dated 24.08.2015 drawn on State Bank of India, Krishnagiri to the Forensic Department, Chennai and thereby to obtain the Expert's opinion of the Handwriting Expert and the age of the paper and difference in the ink in respect of the cheque and the same was allower by the Learned Judicial Magistrate No.I, Krishnagiri in Crl.M.P.No.1057 of 2016 against S.T.C.No.1184 of 2015 dated 28.09.2016, the above said petition was allowed, hence the petitioner/complaint is filing Revision before this Hon'ble Court, at the time of final hearing the Revision Petitioner to raise additional grounds against the order of allowed against the Petitioner/complainant.

O R D E R

The learned counsel appearing for the petitioner on instructions submits that he is willing to withdraw the Criminal Revision Petition and also made an endorsement to that effect. The learned counsel further requested this Court to fix an outer limit time to get an expert opinion from the Handwriting Expert. 2.In view of the fact that the Revision Petition is pending before this court for a long period of time, I am inclined to direct the learned Magistrate to forward the instrument i.e. Cheque bearing No.750651 dated 24.08.2015 as per order dated 28.09.2016 in Crl.M.P.No.1057 of 2016, passed by the learned Judicial Magistrate No.1, Krishnagiri and complete the process within a period of three months.

5.In view of the above direction and also the endorsement made by the learned counsel for the petitioner, this petition stands dismissed as withdrawn. Consequently, connected miscellaneous petitions is closed.
