ORDER : The Court Made the following order The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Section 8(c) and 20 (b)(ii)(B) of Narcotic Drugs & Psychotropic Substances Act, 1985, in Crime No.1275 of 2020, seeks anticipatory bail.
2. There are totally five accused in this case and the petitioner is A4. The allegation is that the petitioner and other accused were found in possession of 1.5 kgs of Ganja. Hence, the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.
4. The learned Additional Public Prosecutor vehemently opposed this petition stating that the arrested accused (A1 to A3) are still https://hcservices.ecourts.gov.in/hcservices/
in judicial custody. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.
5. Considering the submission made by the learned Additional Public Prosecutor that the arrested accused are still in judicial custody and also the accused were found in possession of 1.5 kgs of ganja, this Court is not inclined to grant anticipatory bail to the petitioner.
