C.P.M.Jayapal (Died) v. Marimuthu

CMP.Nos.1589, 1590 & 1591 of 2008 in SA.No.316 of 1999 RMT.TEEKAA RAMAN,J., CMP.No.1589 of 2008 has been filed to condone the delay of 518 days in filing an application to set aside the abatement caused due to the death of the first appellant/C.P.M.Jayapal. CMP No.1590 of 2008 has been filed to set aside the abatement caused due to the death of the first appellant/C.P.M.Jayapal in the above second appeal. CMP.No.1591 of 2008 has been filed to bring on record the legal heirs of the first appellant/C.P.M.Jayapal as appellants 8 to 12 in the appeal and they are petitioners 7 to 11 in the petitions. 2.Heard both sides. The factum of the death of the first appellant/C.P.M.Jayapal in the appeal in S.A.No.316 of 1999 as their legal representatives are not in dispute.

3.Considering the submissions made on behalf of the learned counsel for the applicants and being satisfied with the reasons stated in the affidavit filed in support of these applications, all these applications are allowed. 4.Registry is directed to carry out the necessary amendment in the cause title.
