2. Heard the learned counsel for the petitioner / appellant.

3. It is very unfortunate that though the Appeal was dismissed for default on 05.08.2004 and this petition seeking restoration was filed before the Registry on 07.09.2004, it is not listed for quite a long time.

4. Having regard to the reasons stated in the affidavit filed in support of the above petition and being satisfied with the same, this petition, seeking restoration of CMA No.2192 of 2004 to the file of this Court, is allowed as prayed for.
