The petitioner, who was arrested and remanded to judicial custody on 14.12.2022 for the alleged offence under Sections 464, 473, 476 and 420 of IPC in Crime No.937 of 2022 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner along with other accused who runs a E-service shop, created and used the forged and fabricated seal and signature of the defacto complainant and gain unlawful enrichment from the general public. Hence the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not at all committed any offence as alleged by the respondent police and he has been falsely implicated in this case. He further submitted that that the petitioner has been suffering incarceration from 14.12.2022 and she is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for respondent submitted that the petitioner along with other accused who runs a E-service shop, created and fabricated the seal and signature of the defacto complainant and gain unlawful enrichment from the general public. He further submitted that A1 and A3 in this case are still absconding and if the petitioner is granted bail at this stage, she will abscond and tamper the evidence. He also submitted that the investigation is at the preliminary stage. Hence, he opposed to grant bail to the petitioner.

Considering the facts and circumstances of the case and the submissions made by both counsel and considering the gravity of offence committed by the petitioner and the investigation is not yet completed, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
