..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus (i) to direct the respondents 1 & 3 to issue patta to the petitioner regarding the property in survey No.123/1B new survey No.123/26 of Kovilambakkam Village, Sholinganallur Taluk, Kancheepuram District bearing Door No.392, Baliga Road, Kovilambakkam, Chennai -129 to an extent of 7217.5. sq.ft. as per the registered sale deed dated 25.11.1998 in Doc.No.3580/1998 using the same parameter they followed while granting patta to the other occupants of land in the same survey number 123/26 of Kovilambakkam Village (2) to direct the respondent their men and agents not to interfere with my peaceful possession and enjoyment of the above said property without following due process of law.

O R D E R

[Order of the Court was made by M.VENUGOPAL, J.] The Learned Counsel for the Petitioner has made an endorsement to the effect that liberty may be granted to the Petitioner to file a suit before the Competent Court. Therefore, the Petitioner may be permitted to withdraw this Writ Petition.

2.Recording the aforesaid fact and the endorsement so made, the Writ Petition is dismissed as withdrawn. However, this Court grants liberty to the Petitioner to approach the Civil Court for filing of the Civil Suit and to seek appropriate remedy in the manner known to Law and in accordance with Law, if he so desires/advised. No costs. Consequently, connected Miscellaneous Petition is also dismissed.
