Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondent authority to give permission to conduct Cultural programme (Adal Padal) in the event of Kariakattukuppam Arulmigu Sree Velleriamman & Gengaiamman Temple Festival at Kanchipuram Taluk & District on 18.08.2018 & 20.08.2018 between 06.00 PM to 11.00 PM by considering the Petitioner's representation dated 31.07.2018 For Petitioner ::

ORDER

The petitioner seeks a direction to the respondent to grant permission to the petitioner herein for organizing the cultural function (Adal Padal) at Kariakattukuppam Arulmigu Sree Velleriamman & Gengaiamman Temple Festival at Kanchipuram Taluk & District on 18.08.2018 & 20.08.2018 between 06.00PM to 11.00 PM by considering the Petitioner's representation dated 31.07.2018.

2. The learned counsel appearing for the petitioner submitted that the petitioner is a resident of Kanchipuram Taluk and District and also claims to be the president of the Vizha Commttee. Since the committee has been conducting the cultural programmes as a part of temple festival every year in a peaceful manner without any untoward incident in the past, he has submitted a representation to the respondent on 31.07.2018 seeking permission to conduct the cultural programme on 18.08.2018 & 20.08.2018. As the said representation has not been considered by the respondent so far, the petitioner is before this Court.

The learned Additional Government Pleader appearing for the respondent submitted that the said village is predominantly occupied by Fishermen Community and there was a clash between two groups last year. Therefore, if both the groups come forward giving an joint undertaking that they would not create any law and order problem while holding the function, there will not be any difficult for the respondent.

Recording the submission of the learned Additional Government Pleader appearing for the respondent, both the groups in the village are directed to give a common and joint undertaking to the Inspector of Police ensuring that they would not cause any law and order problem while celebrating the village festival. On giving such undertaking, the respondentInspector of Police, J-12, Kanathur Police Station, Kanathur, Kanchipuram District shall grant permission with usual conditions.

Wih the above directions, the Writ Petition is disposed of. No costs.
