2.The petitioner has filed this writ petition seeking issuance of Writ of Certiorari calling for the records of the first respondent relating to Na.Ka.No.1491/2019/VeSeSa dated 11.12.2025, quash the same. 3.The learned Senior Counsel appearing for the petitioner submitted that the petitioner was appointed as temporary Saleswoman in the Office of Venganur Primary Cooperative Bank Limited on 14.07.1990 and her services were subsequently regularised with effect from 16.03.1993 by virtue of the proceedings of the Special Officer, Venganur Primary Agricultural Cooperative Credit Society and was promoted as Clerk with effect from 29.03.2008 and was further promoted as Senior Clerk on 01.08.2016 and was further promoted as Assistant Secretary on 01.02.2020 and was further promoted as Secretary vide proceedings of the first respondent dated 21.07.2023 and was posted at

Palinganatham Primary Agricultural Cooperative Credit Society on 03.08.2023. The learned counsel further submitted that the petitioner was thereafter transferred to Thirumanur Primary Agricultural Cooperative Credit Society vide proceedings of the first respondent dated 03.07.2024. Whileso, the first respondent passed the impugned proceedings dated 11.12.2025 transferring the petitioner from Thirumanur Primary Agricultural Cooperative Credit Society to Pudupalayam Primary Agricultural Cooperative Credit Society. The learned counsel further submitted that the petitioner was transferred within one and a half year from the earlier transfer which is not sustainable one.

The learned counsel further submitted that the petitioner is 53 years old and she is suffering from age related issues and further submitted that the petitioner is residing at Venganur and the distance between the newly transferred place and her residence is more than 40Km and prayed to quash the impugned proceedings. 4.Per contra, the learned Special Government Pleader (Cooperative) submitted that there are lot of complaints against the petitioner from the general public, thereby, the transfer order was passed and further submitted that as per the annexure to the Letter of the Registrar of Cooperative Societies dated 22.02.

2022, the common cadre employee shall be transferred once in three years, however, in case of complaints and on appropriate administrative grounds, common cadre employee can be transferred even before expiry of the above term of period.

5.Heard the arguments advanced on either side and perused the materials available on record.

6.Admittedly, the petitioner was appointed as temporary Saleswoman in the Office of Venganur Primary Cooperative Bank Limited on 14.07.1990 and her services were subsequently regularised with effect from 16.03.1993 by virtue of the proceedings of the Special Officer, Venganur Primary Agricultural Cooperative Credit Society and was promoted as Clerk with effect from 29.03.2008 and was further promoted as Senior Clerk on 01.08.2016 and was further promoted as Assistant Secretary on 01.02.2020 and was further promoted as Secretary vide proceedings of the first respondent dated 21.07.2023 and was posted at Palinganatham Primary Agricultural Cooperative Credit Society on 03.08.2023. Thereafter the petitioner was transferred to Thirumanur Primary Agricultural Cooperative Credit Society vide proceedings of the first respondent dated 03.07.

2024 and vide impugned proceedings of the first respondent dated 11.12.2025, the petitioner was again transferred from Thirumanur Primary Agricultural Cooperative Credit Society to Pudupalayam Primary Agricultural Cooperative Credit Society. 7.

Government Pleader (Cooperative) contends that there are lot of complaints against the petitioner from the general public, thereby, the transfer order was passed, however, the complaints are not reflected in the impugned proceedings. Even assuming that the petitioner committed irregularity, it is the duty caste upon the respondents to place the petitioner under suspension and proceed further in accordance with law and transfer order is not a punishment. Hence, the impugned proceedings warrant interference. 8.The writ petition is allowed. The impugned proceedings of the first respondent dated 11.12.2025 is set aside. Liberty is granted to the respondents to initiate disciplinary proceedings against the petitioner in accordance with law if there is any serious complaint against the petitioner. No costs. Consequently, the connected miscellaneous petitions are closed. 12-01-2026 PRI
