Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 3rd respondent to consider the representation dated 01.10.2024 within a time frame to be fixed by this Court.

ORDER

This Writ Petition has been filed in the nature of a Mandamus seeking a direction against the 3rd respondent to consider the representation given by the petitioners on 01.10.2024.

2.In the affidavit filed in support of the writ petition, it had been contended that the 1st petitioner, M.Daisy Rani, had been appointed as Staff Nurse by the IRT and working at Government College and Hospital, Perundurai, Erode. The 2nd petitioner, D.Lathamary, had also been appointed as Staff Nurse by the IRT and working at Government College and

Hospital, Perundurai, Erode. It had been stated that owing to various acts of commission and omission of the 1st respondent, who was the Dean of the college, the increments had been cut from the petitioners herein. Both the petitioners had filed W.P.No.18862 of 2017 and W.P.No.32116 of 2018 respectively and they were disposed of by this Court. It had been stated that the petitioners had not been granted their promotion and increment. Claiming that they should be considered for the promotion and increment, they had given a representation to the respondents. 3.The learned Special Government Pleader on instructions stated that the IRT had now been taken over by the Health and Family Welfare Department vide G.O.Ms.No.81, Health and Family Welfare Department dated 14.03.

2024 and that 317 employees would be eligible for promotion in the existing vacancies in accordance with their eligibility. If both these petitioners herein fulfil those conditions either both of them or either of them would be considered for promotion. It all depends on the vacancies which are available. It had been further stated that the earned leave benefits and all other benefits would also extended to them.

Government and once it is received, the same would be disbursed to the petitioners herein. It had also been stated that annual increments would be given regularly.

4.The respondents may examine the service records of the petitioners and also examine whether annual increments had been given and if not, pay the same to the petitioners and also examine whether the petitioners would be eligible for promotion in the 317 vacancies and if they are eligible and vacancies are available, pass necessary orders for promotion. It all depends on the service records of the petitioners and their eligibility. The entire exercise may be completed within a period of three months from the date of receipt of a copy of this order.

5.With the above observations, this Writ Petition stands disposed of. No costs.
