JUDGMENT

This civil miscellaneous appeal was filed questioning the correctness of the order dated 28.2.2011 passed in I.A.No.289 of 2010 in O.S.No.83 of 2010 by the learned Principal District Judge, Erode.

2. Only notice of motion was ordered in the appeal returnable in two weeks. After eight years, when the matter was taken up for final hearing, the learned counsel for the appellants, on instructions, fairly stated that the parties have settled the matter. He has also produced the letter dated 3.3.2015 issued by the Union Bank of India in this regard before the Court.

3. A perusal of the said letter clearly shows that the company had cleared the dues by one time settlement and the related accounts were also closed. In view thereof, this civil miscellaneous appeal is dismissed, as the parties have settled the matter. Consequently, M.P.No.1 of 2011 is also dismissed. No costs.
