Respondent(s) PRAYER; This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents to consider petitioner representation dated 17.11.2025 and 17.12.2025 and to grant pensionary benefits and terminal benefits by taking account of 50 percentage temporary service of teh petitioner served in respondent corporation from 22.09.1988 to 01.01.1998 as per G.O..Ms.No.408 finance (Pension) department dated 25.08.2009.

ORDER

This petition has been filed seeking a direction to the respondents to consider petitioner representation dated 17.11.2025 and 17.12.2025 and to grant pensionary benefits and terminal benefits by taking account of 50 percentage temporary service of the petitioner served in respondent corporation from 22.09.1988 to 01.01.1998 as per G.O..Ms.No.408 finance (Pension) department dated 25.08.2009.

2. It is the case of the petitioner that she is the retired employee of Sanitary Worker in the second respondent Corporation. She was appointed as a Sanitary worker on temporary basis and she was regularised from 01.01.1998. She retired from service on 30.04.2023. After retirement, she received regular service benefit of the pension and terminal benefits from 01.01.1998. But she did not received any service benefits of temporary service period from 22.09.1988 to 01.01.1998. Therefore, the petitioner made a representation to the respondents to grant service benefits of service on the temporary period and the same is not considered. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Government Counsel appearing for the respondents submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the second respondent to consider and pass orders on the petitioner's representation dated dated 17.11.2025 and 17.12.2025 within a period of six weeks from the date of receipt of a copy of this order.
