ORDER

The writ petition has been filed seeking a direction to the first respondent to issue new passport to the petitioner by considering his Passport Renewal Application No.MA3076867464924 dated 21.08.2024 within the time frame fixed by this Court.

2. The petitioner would submit that he holds a passport bearing No.Z2963447, which had expired on 19.09.2024. In order to renew the said passport, he made an application on 21.08.2024 to the first respondent through online and the same was assigned File No. MA3076867464924. After subsequent events, when the petitioner approached the second respondentPolice, he was informed that an FIR is pending against him in W8 All Women Police Station, Thirumangalam.

3. The petitioner would contend that owing to a matrimonial dispute his erstwhile wife had lodged a complaint before the W8 All Women Police Station in the year 2021 and an FIR in Crime No.7 of 2021 came be registered.

4. The learned counsel appearing for the petitioner would submit that the couple have got divorced and each of them have started a new marriage life. He would also submit that, as on date, no charge sheet has been filed and no summons has been served on the petitioner.

5. Heard the submissions of the counsels and this Court also perused the records.

Taking note of the fact that an FIR was registered against the petitioner in the year 2021, and no charge sheet has been filed till date, the first respondent is directed to consider the petitioner's representation seeking renewal of his passport and pass appropriate orders, if all other parameters are found to be in order, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. The 1st respondent shall bear in mind the dicta laid down in a recent judgment of the Hon'ble Supreme Court reported as Mahesh Kumar Agarwal Vs Union of India [SLP(Civil) No.17769 of 2025]. Accordingly, this writ petition is allowed. No costs.
