2022-06-09Honourable Mr Justice C.V. Karthikeyan2 pages

C.M.P.Nos.1886, 1887 and 1888 of 2003 in S.A.No.19 of 2000 C.V.KARTHIKEYAN,J.

These three applications had been filed consequent to the death of the sole appellant, seeking to condone the delay of 6 days in filing application to bring on record his legal representatives and as a consequence to that, appeal has become abated, to set aside the abatement and to bring on record legal representatives. 2.In view of the fact that, it would only be appropriate that the right to prosecute the appeal flows to the legal representatives of the deceased appellant, the applications are allowed. 3.The Registry is directed to make necessary corrections in the cause title indicating the death of the sole appellant R.Ponnusamy and bring on record as his legal representatives, his widow / M.P.Palaniammal, son / P.Dhandapani and daughter / Tmt.Selvarani as appellants 2, 3 and 4.
