ORDER

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8 (c), 20 (b) (ii) (B), 25 and 29 (1) of Narcotic Drugs & Psychotropic Substances Act, 1985 and 25 (1 A) Arms Act 1959, in Crime No.633 of 2025, on the file of the respondent Police, seek anticipatory bail.

2.The allegation against the petitioner is that the petitioner is ranked as A6 in this case and he is a Police constable. It is alleged that the petitioner __________Page 1 of 4

joined hands with ganja peddlers sold ganja and also collected money from them. Hence, the case has been registered.

3.The learned counsel for the petitioner submitted that the statement recorded from the other accused revealed that no money was paid to the petitioner and it was paid only to some other accused. He further submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Criminal side) reiterated the prosecution case and submitted that there are totally six accused in this case and the petitioner is ranked as A6. In this case, 1.5 kg of ganja and 5 g of OG ganja were recovered from the accused. It is further submitted that this petitioner handed over 20g of ganja to A2 for the purpose of sale and collected money from him. In this regard, the petitioner's statement was verified and it reveals that he collected money through Gpay by engaging an individual one Sundar. Consequently, the petitioner was also added as an accused. Further, the investigation in this case is pending. Hence, she opposed for grant of anticipatory bail to the petitioner.

5. Heard the learned counsels on either side and perused the materials available on record.

6.Considering the fact that there are bank transactions made between the the petitioner and the other accused, and the petitioner being a Police Constable involved in such offence, could not be considered litely and the fact that investigation in this case is pending, I am not inclined to grant anticipatory bail to the petitioner.
