This Civil Miscellaneous Appeal is filed under Section 173 of Motor Vehicles Act, 1988, against the judgment and decree made in MACTOP.No.83 of 2008 dated 05.09.2008 on the file of the Motor Accident Claims Tribunal-cum-Fast Track Court No.3, Virudhachalam, Cuddalore District.

J U D G M E N T

The appellant is the owner of the vehicle who has been held liable for paying compensation amount of Rs.3,82,000/- to the claimants alongwith interest at 7.5%. The appellant counsel has sent an information regarding listing of this appeal before the https://hcservices.ecourts.gov.in/hcservices/

Court. In reply, the appellant sent his reply stating that the said CMA.No.3348 of 2009 in MACTOP.No.83 of 2008 has to be withdrawn as the appellant is paying the award amount periodically before the Court below. The learned counsel for the appellant has also produced the copy of the communications before this Court.

The learned counsel for the appellant has also made an endorsement for withdrawing the appeal. Recording the said endorsement, the civil miscellaneous appeal is dismissed as withdrawn. Consequently, connected miscellaneous petition is closed. No costs.
