The petitioner apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 341, 294(b), 323, 324 and 506 (ii) IPC in Crime No.746 of 2016, on the file of the respondent police, and he seeks anticipatory bail.

It is the case of the prosecution that one Vishal lodged a complaint before the respondent-Police stating that there was clash between to parties in his locality; on 13.04.2016, at about 07.30 p.m., when the de-facto complainant was standing in Mathialagan Street, the petitioner along with the other accused and others came and abused the de-facto complainant with filthy language and assaulted him with hockey stick, thereby caused injury on him.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and that he is innocent of the offences alleged against him and he is having permanent residence and the learned counsel prayed that the petitioner may be granted anticipatory bail.

4. The learned Additional Public Prosecutor appearing for the respondentPolice submitted that the injured has been discharged from the hospital.

5. Considering the fact that the injured has been discharged from the hospital and also considering the nature of offences alleged against the petitioner and that he is having permanent residence and also taking into account the facts and

r n s / c s circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail, in the event of arrest, or on his appearance before the learned XVIII Metropolitan Magistrate, Saidapet, Chennai, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the said learned Metropolitan Magistrate and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

The petitioner shall surrender before the said learned Metropolitan Magistrate within a period of three weeks from the date on which the order copy is made ready, failing which, the anticipatory bail granted herein shall stand dismissed. 04.05.2016 rns/cs Crl.O.P.No.10220 of 2016
