O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 324(2), 326(g), 329(4), and 351(3) of BNS in Crime No.105 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioner is that the petitioner herein due to property dispute, entered into the house of the defacto complainant and damaged the house hold articles worth about Rs.20,000/- and also threatened the defacto complainant to send her daughter ( wife of the petitioner) otherwise, he would murder the defacto complainant and his wife. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and due to matrimonial dispute, false complaint has been lodged. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that, petitioner herein married the daughter of the defacto complainant and also continuously harassed her and hence while she was staying in her parents house, petitioner caused damages to the properties worth about Rs.25,000/-. He further submitted that the petitioner is having 3 previous cases.

5. Considering nature of allegations and also considering the bad antecedents of the petitioner and value of damages caused, this Court is not inclined to grant anticipatory bail to the petitioner.
