C.M.P.No.17851 of 2004 in S.A.No.1390 of 2003 C.V.KARTHIKEYAN.,J The Second Appeal arises out of O.S.No.249 of 1998 which was on the file of the District Munsif Court, Omalur. The said suit was filed by the appellant herein. The suit was dismissed. Thereafter, the appellant filed A.S.No.40 of 2001 on the file of the Sub Court, Mettur. The said first appeal was also dismissed. This has necessitated the plaintiff to file the present Second Appeal and also the Second Appeal had been admitted and the substantial questions of law had been framed. 2.The facts necessitating filing of the Suit and the Second Appeal had been reduced in the order dated 10.06.2022.

3.The present Civil Miscellaneous Petition has been filed to implead two other sisters of the appellant, who is also now deceased. I do not think there would be any bar in impleading the two sisters as they stand on the 2/2 https://www.mhc.tn.gov.in/judis

C.V.KARTHIKEYAN.,J smv same footing as 3rd and 4th respondents, who are legal representatives of the another brother. In view of that particular fact, the Civil Miscellaneous Petition is allowed.
