The present Civil Miscellaneous Second Appeal has been filed under Order 21 Rule 58 (4) read with Section 100 of Civil Procedure Code against the judgment and decree dated 14.6.2002 in A.S.No.39/2001 passed by the learned Principal Subordinate Judge, Gobichettipalayam, confirming the judgment and decree dated 20.09.2001 in E.A.208/2000 in E.P.No.83/2000 in O.S.No.304/1991 passed by the learned District Munsif, Sathyamangalam.

When the matter is called today, the learned Counsel for the appellant reported ''no instructions'' from his client and she has also made an endorsement to that effect. The learned Counsel further stated that recording th e same, the present appeal may be closed.
