J U D G M E N T
The defendant in the suit in O.S.No.8326 of 2011,on the file of the Additional District Judge, Fast Track Court No.II, Chennai - 600 001, is the appellant in this appeal.
2. It is represented that the parties namely the appellant and the respondent in the appeal have settled the matter amicably by entering into a compromise. A compromise memo jointly signed by both parties namely the appellant and the respondent in the presence of their respective counsels dated 05.03.2020 is filed before this Court.
3. The learned counsel appearing for the appellant submitted that the counsel for the appellant and the appellant are present and it is represented that the respondent and the counsel for the respondent are also connected to the conference. He would further submit that the appeal may be disposed of in terms of the compromise memo by directing the appellant to execute the registered sale deed measuring an extent of 4354 sq.ft as per the sketch appended to the compromise memo. 4. This Court is inclined to dispose of the appeal in terms of the compromise memo dated 05.03.2020. Accordingly, the judgment and decree of the lower Court is modified by directing the appellant to execute a sale deed in respect of the two plots bearing plot Nos.21 part, 22 and 23 totally measuring an extent of 4354 sq.ft., as per the sketch appended to the compromise memo signed by both parties, in favour of the respondent or her nominee within 30 days from the date of recording the compromise.
5. The appeal is accordingly disposed of in terms of the compromise memo. The compromise memo dated 05.03.2020 signed by the parties in the presence of their respective counsels and the sketch appended to the joint compromise memo shall form part and parcel of the decree.
