ORDER

This petition has been filed seeking for transfer of all proceedings in S.T.C.No.844 of 2011 pending on the file of the learned Additional Sessions Court, Ariyalur to the learned Principal Sessions Court, Perambalur.

2.The transfer petition has been filed mainly on the ground that the respondent is a practicing Advocate in the same Court. Therefore, the petitioner will not be able to get a fair trial before the Court below.

3.When the matter is taken up for hearing, there is no representation on behalf of the petitioner and the learned counsel for the respondent submitted that in view of the pendency of this case, there was absolutely no progress in the case in S.T.C. No.844 of 2011.

4.Taking into consideration the facts and circumstances of this case, this Court is not inclined to transfer the proceedings at this length of time. The Court below is directed to complete the proceedings in S.T.C.No.844 of 2011, within a period of three months from the date of receipt of copy of this order.

5.Accordingly this Criminal Original Petition is disposed of. Consequently, the connected miscellaneous petition is closed.
