Mr.P.Kandasamy, counsel for the appellant and Mr.P.Sankara Narayanan, counsel for the respondents 1 to 5 are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT Both parties and their respective counsel are present today and the counsel for both sides have made endorsements on the grounds of Appeal Suit on various dates to the effect as follows:- 10.06.2015 " Received a sum of Rs.5,00,000/- out of Rs.11,00,000/- by cash on 10.06.2015."

" Received a sum of Rs.2,50,000/- out of the balance of Rs.6,00,000/- by cash on 13.07.2015"
12.08.2015 " Received a sum of Rs.1,50,000/- out of the balance of Rs.3,50,000/- by cash on 12.08.2015"
16.09.2015 " Received a sum of Rs.2,00,000/- out of the entire balance. No further amount is due.
Appeal may be disposed of as compromised. Entire compromised amount towards decree is discharged. "
2. In view of the endorsement made by the parties and their counsel, the Appeal Suit is disposed of as compromised. The decree in O.S.No.573 of 2004 on the file of Additional District Judge, Fast Track Court - I, Poonamallee is also discharged. Consequently connected Miscellaneous Petition is closed.
3. The full Court fee shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994 and there shall be no demand for additional Court fee.
