JUDGMENT

The appeal is filed by the accused in Spl.C.C.No.17 of 2020 on the file of Sessions Judge, Special Court for exclusive trial of cases under POCSO Act, Chennai, and he was tried for the offences under Section 366 IPC, Section 9 of Prohibition of Child Marriage Act and Section 4 of the Prevention of Children under Sexual Offences Act, 2012 ('POCSO' Act). After trial, the appellant/accused was convicted for the offence under Section 366 IPC and was sentenced to seven years imprisonment with a fine of Rs.5,000/-, in default to undergo three months simple imprisonment and was also convicted under Section 4 of the POCSO Act, 2012 and sentenced to seven years imprisonment with a fine of Rs.5,000/-, in default to undergo three months simple imprisonment. The offence under Section 9 of the Prohibition of Child Marriage Act was held not proved. No award of compensation was ordered under Section 33(8) of the POCSO Act.

2. Assailing the aforesaid conviction and sentence imposed on the appellant, the present appeal has been preferred.

3. By order dated 23.06.2022, the sentence was suspended and the appellant was enlarged on bail on certain conditions. Pending appeal, the appellant had died on 22.09.2023. The death certificate dated 11.10.2023 is produced before this Court certifying the death of the appellant on 22.09.2023.

In view of the death of the appellant pending appeal, the appeal stands dismissed as abated.
