ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148, 448 of IPC and 3 (1) TNPPD Act in Crime No.1200 of 2017 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that due to wordy quarrel, the petitioners attacked the defacto complainant and damaged his property.
3. The learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case.
4. The learned Government Advocate (crl.side) would submit that due to civil dispute, the petitioners attacked the defacto complainant and caused damages to his property. He would further submit that the petitioners have already filed a suit and obtained interim injunction in their favour.
5. Having regard to the fact that the matter pertains to civil dispute and also the fact that the petitioners have obtained interim injunction in respect of the property in question, this Court is inclined to grant anticipatory bail to the petitioners.
6. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned XXII Metropolitan Magistrate, Egmore, Chennai within a period of 10 days from the date of receipt of a copy of this order, on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned XXII Metropolitan Magistrate, Egmore, Chennai and on further condition that the petitioners shall appear before the Court concerned as and when required.
