(Order of the Court was made by S.S.SUNDAR, J.) This petition is filed by a third party to implead him as a party to the proceedings. It is admitted that the writ petition is filed challenging the order passed by the Tamil Nadu Pollution Control Board directing closure of the unit and disconnection of the power supply. The petitioner is a resident of a place where the writ petitioner has established the industry.

2. Even in the affidavit filed in support of the petition, the petitioner has stated that the impugned order is on the basis that there are law and order problems and there is public protest. It is in the said circumstances, the petitioner states that he is put to irreparable injury on account of the consent given to the petitioner unit. In the affidavit it is stated that the operation of the petitioner's unit is a problem to several families residing in and around the village.

3. Since the matter relates to pollution, the petitioner also is a proper and necessary party. Hence, this petition is ordered as prayed for. (S.S.S.R.,J.) (N.S.,J.) 08.02.2024 Registry is directed to carryout Page No.1/3
