O R D E R

(The case has been heard through video conference) The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 21(1) of Mines and Minerals (Development & Regulation) Act, 1957 and Section 379 of IPC in Crime No.604 of 2020, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with the other accused are said to have transported eight units of river sand illegally by using the vehicle bearing Registration No.TN 20 BK 9159. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not indulged any offence as alleged by the prosecution and he has been falsely implicated in this case.

4. The learned Additional Public Prosecutor appearing for the State submitted that the petitioner was said to have transported eight units of river sand illegally and that there are three previous cases pending against the petitioner. Hence, he strongly opposed to grant anticipatory bail.

5. Considering the fact that the petitioner has involved in serious offence and that the petitioner has three pending cases, this Court is not inclined to grant anticipatory bail to the petitioner.
